Q. I have an insured with a teenage son who just got his license and the parents want to exclude him on their policy and write him a separate named non-owner policy. Can we do that?
A. The teenager would be covered for liability, PIP and UM/UIM while driving the parent’s auto, but the parents have no liability while he is driving as the non-owner policy does not cover them and their PAP would exclude him.
The parents may be held liable based on the ownership of the auto and possibly for negligent parental supervision and negligent entrustment. Plus, if the teen wrecks the car, neither the parent’s PAP nor the named non-owner policy is going to cover damage to the family car.
